Terms & Conditions

1. Acceptance of the Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms; where this option is made available to you by "SpicePack" in the user interface. 

2. Registration to use the Purchase Services

In order to access the Purchase Services, you must first register as a user of the Website. As part of the registration process, or as part of your continued use of the Purchase Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

•    an email address

•    preferred username

•    a mailing address

•    a telephone number

•    a password

•    Full Name, date of birth.

You ensure that any information you give to SpicePack in the course of completing the registration process will always be accurate, correct and up to date.

Once you have completed the registration process, you will be a registered Customer of the Website (“Customer”) and agree to be bound by the Terms. As aCustomer, you will be granted immediate access to the Purchase Services.

You may not use the Purchase Services and may not accept the Terms if:

* you are not of legal age (below 18 years) to form a binding agreement with SpicePack; or

* you are a person barred from receiving the Purchase Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Purchase Services.

3. Australian Sales only

We only sell and ship Products within Australia. We will not make deliveries outside of Australia

4. Correction of Errors and Inaccuracies; Limitations on Quantity

Whilst SpicePack makes every reasonable effort to present accurate information on this website, the information may contain typographical errors or inaccuracies and may not be complete or current. We, therefore, reserve the right to correct any errors, inaccuracies or omissions and to change or update information on the website at any time (including after you have submitted your order). If this affects an order you have placed we will contact you to advise of the change and give you the option of a refund or to proceed with the order as amended. Please note that such errors, inaccuracies or omissions may relate to product description, pricing, and availability. We also reserve the right to limit quantities (including after you have submitted your order). We apologize for any inconvenience this may cause you. If you are not fully satisfied with your purchase please see our returns policy for details on how to obtain a refund.

 

5. Placing an Order

You may place an Order by adding items to ‘Spice Cart’ on SpicePack Website and clicking the "Check Out" button. When you place your Order, we will issue you with an Order Number. We will do this by email. By placing an Order, you make an offer to us to purchase the Products you have selected based on these terms and Conditions. Information contained on the SpicePack website constitutes an invitation to treat. No information on our website constitutes or should be deemed as an offer by us to supply any products, however, SpicePack will make every effort to supply products to you. We will notify you that your order is being processed by sending you an Order Confirmation via email, however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. SpicePack and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when your order status moves to dispatched in the My Account My Orders Section. If we cannot process or accept your Order after payment is received we will contact you by email or telephone.

 

6. Payment method and Refund policy

SpicePackuses Braintree to provide a secure environment for the authorization of credit card and charge card transactions. We also offer PayPal and master pass payment solutions.   Confidential information including card details are encrypted using industry standard SSL 128-bit encryption technology. 

 

SpicePack may, at their sole discretion, provide a refund on the return of the Products within 30 days where the Product packaging is unopened and remains in a saleable condition. You acknowledge and agree that you are liable for any postage and shipping costs associated with any refund pursuant to this clause.

 

7. Warranty for online purchases

SpicePack's Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for the amajor failure of the Product. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure (the 'Warranty').

You may make a claim under this clause (the 'Warranty Claim') for material defects and workmanship in the Products within from the date of purchase (the'Warranty Period').

In order to make a Warranty Claim during the Warranty Period, you must provide proof of purchase to SpicePack showing the date of purchase of theProducts, provide a description of the Products and the  price  paid  for  the  Products  by  sending written  notice  to  SpicePack at Warehouse 4,3 Leader St, Truganina VIC 3029 or by email at info@SpicePack.com.au

Where the Warranty Claim is accepted then SpicePack will, at its sole discretion, either repair or replace any defective Products or part thereof with a new or remanufactured equivalent during the Warranty A period at no charge to you for parts or labor. You acknowledge and agree that you will be solely liable for any postage or shipping costs incurred in facilitating the Warranty Claim.

The Warranty shall be the sole and exclusive warranty granted by SpicePack and shall be the sole and exclusive remedy available to you in addition to other rights and under a law in relation to the Products to which this warranty relates.

All implied warranties including the warranties of merchantability and fitness for use are limited to the Warranty Period.

The Warranty does not apply to any appearance of the supplied Products nor to the additional excluded items set forth below nor to any supplied Products where the exterior of which has been damaged or defaced, which has been subjected to misuse, abnormal service or handling, or which has been altered or modified in design or construction.
